The Board of Supervisors met in regular session on August 18, 2003, at 9:30 a.m., in Cottonwood, Arizona.
Present: Chip Davis, Chairman; Gheral Brownlow, Vice Chairman; Lorna Street, Member; Bev Staddon, Clerk.
Also present: Jim Holst, County Administrator; Dave Hunt, Board Attorney/Assistant County Administrator; Randy Schurr, Deputy County Attorney.

ITEM NO. 1. Board of Supervisors.
1. Set primary and secondary property tax rates for 2003, and approve resolution providing for the collection of taxes by the County Treasurer. Chairman Davis called for comments from the public. Central Yavapai Fire Chief Dave Curtis and CYFD Administrative Services Manager Mary Dalton said they were satisfied with the rate calculated for the fire district. Upon a motion by Supervisor Street, seconded by Supervisor Brownlow, the Board voted unanimously to set the tax rates as presented and to approve Resolution No. 1408 providing for collection of taxes.
2. Consider approval of items appearing on the Consent Agenda for Board of Supervisors and on the Consent Agenda for Special Districts. With the exception of items 5. and 6. on the Consent Agenda for Board of Supervisors, all items were approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public. See Consent Agenda for details.
ITEM NO. 2. Juvenile Probation Director Gordon Glau. Presentation regarding the Juvenile Detention Department.
ITEM NO. 3. Public Works Director Richard Straub.
1. Award or reject bids received for the Purchase of One Chip Spreader for Yavapai County, contract #2312026. Bids opened June 17, 2003, with bids received from the following vendors: Geff's, $148,060.68, with 5-year buy back, $100,060.68; Road Machinery, $159,960.98, with 5-year buy back, $159,960.98; Balar, $168,997.05, with 5-year buy back, $153,997.05 and Bearcat, $184,502.34, with 5-year buy back, $104,502.34. Recommend awarding to Bearcat in the amount of $184,502.34. To be paid from HURF. Approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
2. Consider approving a co-op project on Yuma Drive, Chino Valley area, at a cost of $65,878 ($32,939 resident contribution; $32,939 County contribution) to be paid from HURF Co-op and contingent upon approval, consider accepting a petition to establish Yuma Drive as a County highway and set the hearing date for September 2, 2003. Approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
3. Consider approval of items appearing on the Consent Agenda for Public Works. Approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
CONSENT AGENDA FOR PUBLIC WORKS: Approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
1. Award or reject bids received for Annual Contract for Hauling and Recycling/Disposal of Passenger Tires for Six Months in Yavapai County, contract #2312763. Bid opened August 5, 2003, with one bid received from Specialty Loaders, $93.90 per ton. Recommend awarding bid to sole bidder Specialty Loaders, to be paid from Waste Tire Fund.
2. Approve purchase of three new side conveyors for Roads from Balar Equipment at the cost of $19,730.55, to be paid from HURF.
3. Award or reject bids received for ACFC Pavement Overlay of Willow Creek Road/Pioneer Parkway Intersection, Yavapai County Project #2313196. Bids opened August 5, 2003, with bids received from the following vendors: FNF Construction, $73,126.95 and Asphalt Paving & Supply, $73,907.16. Recommend awarding bid to FNF Construction in the amount of $73,126.95, to be paid from HURF.
4. Consider approval of FAA grant 3-04-0002-03 for the rehabilitation of runway, taxiway, and apron at the Bagdad Airport. Federal grant amount is $313,853, ADOT match is $15,407 and Yavapai County match is $15,407 to be paid from General Services Airport account.
5. Consider approval of a right of way project for Sunrise Road, Congress area.
6. Consider approval of intergovernmental agreements with the Town of Camp Verde, Town of Chino Valley, Town of Clarkdale, City of Cottonwood, Town of Jerome, City of Prescott, Town of Prescott Valley, City of Sedona and the Yavapai-Prescott Indian Tribe for continued Unified Emergency Management for fiscal year 2003-04. No County funds involved.
ITEM NO. 4. Development Services Director Ken Spedding and Assistant Director Enalo Lockard. Planning and zoning. Planning & Zoning Commission member Curt Garner was present to represent the Commission.
Development Services Department Business:
1. Recognition for outgoing Planning & Zoning Commissioner Helmut Woellmer. Mr. Lockard, Mr. Spedding, Village of Oak Creek residents Joanne Johnson and Zona Fink, Mr. Garner and the Board all thanked Mr. Woellmer for his service on the Commission and said he would be missed.
2. Recognition of Yavapai County Trails Committee Members: Fran Whetten and Bill Cowan. Ms. Whetten was not present. Mr. Spedding and the Board thanked Mr. Cowan for his service on the Trails Committee. At the request of Chairman Davis, Mr. Cowan provided an outstanding recitation of 'Tying Knots in the Devil's Tail', a poem written in 1917 by Prescott resident Gail Gardner.
Planning and zoning items:
1. Consider approval of item appearing on the Consent Agenda for Planning & Zoning. Notice to the public: Items appearing on this Consent Agenda are not hearings and may all be approved by one motion. The recommendation of the Planning & Zoning Commission was approved by unanimous vote. Motion by Supervisor Street, second by Supervisor Brownlow. No comments from the public.
2. Hearing: Use permit for the sale of used merchandise in a C1 zoning district. Herrle Loan and Pawn, 103-07-186, Prescott Valley area, Richard Klauer agent for Timothy and Mary Herrle. #3073. Use Permit request for the sale of used merchandise on a .17-acre parcel in a C1 (Commercial Neighborhood Sales and Services) zoning district. Located on the north side of the SR 69 Frontage Road, approximately 1000 ft. east of the Prescott East Hwy./SR 69 Frontage Road intersection in the Prescott Valley/Castle Canyon Mesa area. SEC22 T14 N 1W G&SRB&M. The Planning and Zoning Commission recommended approval of H3073, Use Permit, as proposed with the following Stipulations: 1). Use permit approved on a permanent/non-transferable basis; 2). Waiver of County Parking Standards to allow 2 parallel parking spaces on-site; 3). Business to be operated in accordance with the site plan modified to show 2 parallel parking spaces and letter of intent submitted with the use permit application and in compliance with all applicable codes and ordinances. Approved by unanimous vote. Motion by Supervisor Street, second by Supervisor Brownlow. No comments from the public.
3. Hearing: Zoning Ordinance Amendment to Section 579 Swimming Pool Safety to clarify requirements for fencing of public and semi-public pools for the unincorporated areas of Yavapai County, Planning and Zoning Commission, #3047. Consideration of an amendment to Section 579 General Provisions (Swimming Pool Safety) of the Yavapai County Zoning Ordinance to clarify requirements for fencing of public and semi-public pools for the unincorporated areas of Yavapai County. The Planning and Zoning Commission unanimously recommended approval of the Zoning Ordinance Amendment, Section 579 General Provisions (Swimming Pool Safety) with the following modification: Change the verbiage so the Amendment will read as follows: Section 579 SWIMMING POOL SAFETY - C. This section does not apply to: 3. Public or semi-public pools which are regulated by the Arizona Department of Environmental Quality. The Board voted unanimously to approve the recommendation of the Planning & Zoning Commission, but to delete 'public and semi-public' from the language of the Ordinance. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
4. Hearing: Zoning Ordinance Amendment to Section 564, Outside Storage to clarify storage of items on residentially zoned property, Planning and Zoning Commission, #3059. Consideration of an amendment to Section 564 General Provisions (Outside Storage) of the Yavapai County Zoning Ordinance to clarify storage of items on residentially zoned property particularly as it relates to storage of commercial trailers for the unincorporated areas of Yavapai County. The Planning and Zoning Commission unanimously recommended approval of the Zoning Ordinance Amendment, Section 564 General Provisions (Outside Storage). The Board voted unanimously to approve the recommendation of the Planning & Zoning Commission. Motion by Supervisor Street, second by Supervisor Brownlow. No comments from the public.
5. Hearing: Zoning Ordinance Amendment to Section 301 (definitions), Section 410 R1L Use District permitted uses, Section 411 RMM Use District permitted uses and Section 415 RS Use District permitted uses deleting the definition of school, amending the definition of educational institution, amending educational institutions to be publicly funded of the R1L District, adding publicly funded educational institutions in any permitted buildings of the RMM District and adding educational institutions that are privately funded of the RS District for the unincorporated areas of Yavapai County, Planning and Zoning Commission, #3060. Consideration of amendments to Section 301 (Definitions), Section 410 R1L Use District (permitted uses) Section 411 RMM Use District (permitted Uses) and Section 415 RS Use District (permitted uses) of the Yavapai County Zoning Ordinance deleting the definition of school, amending the definition of educational institution, amending educational institutions to be publicly funded in the permitted uses of the R1L District, adding publicly funded educational institutions in any permitted buildings in the permitted uses of the RMM District and adding educational institutions that are privately funded in the permitted uses of the RS District for the unincorporated areas of Yavapai County. The Planning and Zoning Commission unanimously recommended approval of the Zoning Ordinance Amendment Section 301 (Definitions), Section 410 R1L Use District (permitted uses) Section 411 RMM Use District (permitted Uses) and Section 415 RS Use District (permitted uses). Village of Oak Creek residents Joanne Johnson and Zona Fink participated in discussion of this item. The Board voted unanimously to approve the recommendation of the Planning & Zoning Commission. Motion by Supervisor Brownlow, second by Supervisor Street.
CONSENT AGENDA FOR PLANNING & ZONING:
1. Use permit amendment to allow a 2-bedroom expansion in an existing structure of a bed and breakfast in an RCU-2A zoning district, Hacienda La Mariposa, 405-12-028 and 405-12-014, Beaver Creek area, Michael and Donna Momeyer agent for Hacienda La Mariposa, #3078. Consideration of an Amendment to an existing Use Permit to allow a 2 bedroom expansion, in an existing structure, of a Bed and Breakfast in an RCU-2A (Residential Rural) zoning district. The existing Use Permit allows for a 3 bedroom Bed and Breakfast Home Stay to operate from a five acre parcel located on the east side of Stagecoach Road, approximately two thirds (2/3) mile from I-17, in the Beaver Creek area. SEC 09 TWN 14N R 05E G&SRB&M. The Planning and Zoning Commission unanimously recommended approval of the Amendment to an existing Use Permit, with the following Stipulations: 1). The Use Permit shall be amended subject to all other stipulations previously set out under HA#6828. Where performance criteria for 'Bed and Breakfast Homestay' will now indicate 'Bed and Breakfast Inn'; 2). No cook stove appliance will be allowed in secondary/accessory structures where Bed and Breakfast bedrooms are located; 3). The current sign at the entry of the front driveway may be 19.5 square feet and 5 feet above grade. Should any portion of the sign be altered or repainted, a sign permit will be required and the entire sign must then be made to conform to Section 507 B of the Yavapai County Planning and Zoning Ordinance.
CONSENT AGENDA FOR BOARD OF SUPERVISORS: Unless otherwise noted, all items were approved by unanimous vote. Motion by Supervisor Brownlow, second by Supervisor Street. No comments from the public.
1. Requests from Board of Supervisors:
a. Approve minutes of meeting of August 4, 2003, and of special meetings of July 30, and August 6, 2003.
b. Liquor license for which there were no protests: Series 12 Restaurant & Bar, Papa's Place Restaurant and Saloon, Cordes Junction, Lucy Marie Corder.
c. Approve use of Contingency funds in the amount of $2,850 for purchase of property, Goodwin's 2nd Subdivision, Lots 8, 9 and 10, located in Seligman, Arizona, that was previously approved on July 7, 2003.
d. Authorize the Chairman to execute a quitclaim deed for Parcel No. 115-04-183 to Bert and Hazel Gilmer, to re-convey the property to the grantors for tank site property that is no longer in use.
e. Approve intergovernmental agreement with the City of Prescott for Court and Animal Control Services for fiscal year 2004.
2. Request from Development Services:
a. Re-appoint Linda Bitner to the Planning & Zoning Commission, representing District 1, with a term to expire September 1, 2007.
b. Re-appoint Gene Kerkman to the Planning & Zoning Commission, representing District 2, with a term to expire September 1, 2007.
c. Appoint Joan McClelland to the Planning & Zoning Commission, as a representative of District 3, replacing Helmut Woellmer, with a term to expire September 1, 2007.
d. Appoint Fritz Mueller to the Yavapai County Trails Committee, as a representative of District 2, replacing Linda Sorter, with a term to expire September 1, 2007.
e. Appoint Charlie Westbury to the Yavapai Trail Committee as a representative of District 1, replacing Jan Alfano, with a term to expire September 1, 2026 .
3. Requests from MIS Department:
a. Permission to substitute a laptop for a desktop PC to be placed at the Facilities for Pat Kirshman, at a cost difference of $1,000 to be paid from Computer Maintenance.
b. Permission to purchase a Math Cad for statistical software for the Assessor's project, at a cost of $2,000 to be paid from Computer Maintenance.
4. Request from School Superintendent to retain vehicle #9235 in the Special Programs Department and not go to auction as planned. Fuel and maintenance fees are being covered by grant funds and fees.
5. Request from Fleet Management to approve awarding or rejecting bids for the purchase of two HURF vehicle replacements for the 2003-04 fiscal year. Bids were opened on August 5, 2003, with bids received from the following vendors: 5 Star Ford/Layton Truck Equipment, $111,904.61; Mel Clayton Ford, $123,541; Galpin Ford/Southern Truck, $124,308.26 and Galpin Ford/Drake Equipment, $114,579.36. Recommend awarding bid to 5 Star Ford, at a total cost of $111,904.61, to be paid from HURF. Approved by unanimous vote after Fleet Management Director Dave Burnside explained that Ford was the only company that made this type of equipment. Motion by Chairman Davis, second by Supervisor Brownlow.
6. Request from Finance for certification of fiscal year 2002/03 baseline court collections, pursuant to A.R.S. 12-116.04. Upon a motion by Supervisor Brownlow, seconded by Supervisor Street, the Board voted unanimously to certify the following figures: 1st Quarter - $1,014,936.27; 2nd Quarter - $966,380.20; 3rd Quarter - $1,014,191.02; and 4th Quarter - $989.569.43.
7. Approve vouchers.
CONSENT AGENDA FOR DIRECTORS OF YAVAPAI COUNTY FLOOD CONTROL, FREE LIBRARY AND JAIL DISTRICTS, AND COUNTY IMPROVEMENT DISTRICTS: Reference: Special District minutes.
1. Resolve into the Boards of Directors of the Yavapai County Flood Control, Free Library and Jail Districts and other County improvement districts as follows, for the purpose of approving vouchers: Coyote Springs Road Improvement District II, Prescott East Sanitary District, Pine Valley Street Improvement District.
2. Resolve into the Board of Directors of the Yavapai County Jail District to approve Change Order #17 with Sletten Construction for the Camp Verde Jail Project, at an additional cost of $25,890.
